Whom It May Concern,
§59-65-47
of the South Carolina Code of Laws only mandates by
January thirtieth of each year, all associations shall report the number
and grade level of children home schooled through the association to the
children's respective school districts.
All home schools operating under §59-65-47
of the South Carolina Code of Laws s are not required to provide
any “public school or school district” with any information
about their home school, which operates under §59-65-47
of the South Carolina Code of Laws; and
§59-65-47
of the South Carolina Code of Laws specifically exempts all home schools
operating under §59-65-47
of the South Carolina Code of Laws from the further mandates §59-65-40
and §59-65-45 of the South Carolina Code of Laws; and
Home schools (ANY PARENT or LEGAL GUARDIAN FOR THAT MATTER) do not
have to have any association issued paperwork to obtain a copy of their
child (ren) educational records. South Carolina Code of Law Section
20-7-100: Rights and duties of parents in regard to their minor
children. [SC ST SEC 20-7-100] "Each parent, whether the
custodial or non custodial parent of the child, has equal access and the
same right to obtain "all educational
records and medical records
of their minor children" and the right
to participate in their children's school activities unless prohibited
by order of the court; and
The home school association, home school parent (s) or legal guardian
(s) do not give any permission for any public school, public
school district, or public school official to copy or maintain any
identifying information in any file or place, about the home school,
home school child (ren), parent (s), and/or home school association
issued paperwork. If any public school, public school district, or
public school official is maintaining any said information anywhere on
or about said South Carolina Code of Law Section 59-65-47 home school,
home school child (ren), home school child (ren) parent (s), or home
school association, to include said home school association issued
paperwork, said home school child (ren) parent (s) and home school
association demand a copy of all said information pursuant to South
Carolina Code of Law Section 20-7-100 and formally request all said
information be removed/destroyed immediately thereafter; and TITLE 20 > CHAPTER 31 > Sec. 1232g.(Sec. 1232g. - Family educational and privacy rights) http://www4.law.cornell.edu/uscode/20/1232g.html ; and
Any public school, and/or school district, and/or public school district
official, and/or, which violates any section herein, shall have notice
herein, I/we will take legal action; and
New Beginnings Home School Association has
an expectation of privacy and confidentiality by anyone that calls or
contacts New Beginnings Home
School Association using any electronic communications device to include
internet, email, cellular and cordless phone conversations or using any
form of postal mail. You may not modify, copy,
distribute, transmit, display, perform, reproduce, publish,
license, create derivative works from, transfer, make public or
sell any information obtained from New Beginnings Home School
Association web site, email, any electronic communications device to
include cellular and cordless phone conversations, postal mail, or membership
paperwork without the explicit written permission of New Beginnings
Home School Association! You may not send, or cause to be sent,
any part or anything posted on New Beginnings Home School Association
web site, email, any electronic communications device to include
internet, email, cellular and cordless phone conversations, postal mail
or membership paperwork without the explicit permission of New
Beginnings Home
School Association; and
Any questions should be directed to New Beginnings Home School
Association in writing.
All verification requests need to be made in writing on departmental
letter head and signed by the official making the request, to the
address listed above. Said request must include the telephone
number and extension to the official, which is making said request.
